In 2009, the act 19/2009 of November 23rd was approved, about measures of promotion and procedural expediting of rental and energy efficiency of buildings, published in the BOE Official Gazette number 283 on Tuesday, November 24th, 2009, pages 99625-99633.

The purpose of this law is to encourage new families to access the housing rental market at the expense of ownership through the creation of measures to strengthen legal certainty for the parties and encourage the increase the rental market offer.

One of the measures is the extension of the assumptions of not mandatory extension of the contract when the owner needs housing for first-degree relatives (children, parents or spouse in case of divorce), if specified in contract.

The second measure provided by the law is the one to amend the Civil Procedure Act in the event of house eviction due to lack of rent payment. The law sets a deadline of just one month of delay (previous law set that the minimum term was two months) from the tenant fails to pay rent and after been required the payment via burofax, in order to fill the claim, and allows the landlord to notify the eviction by this mean an avoid the personal contact. Also stipulates that the day of the trial would be set for the eviction to be carried out within one month top. There is no doubt that this law simplifies the process and reduces the about 1,000 Euros costs for the owner.
